GENERAL

The Pet Pros Paw-liday Caricature drawing is sponsored by Lucky Dog Equipment Inc., Inc d/b/a Pet Pros (“Sponsor”). The Contest begins at 12:00 am PST on Friday, November 11, 2022 and ends at midnight PST on Sunday, November 27, 2022. By entering, you agree to be bound by these Official Rules and the decisions of Sponsor respecting the contest.

ELIGIBILITY

To enter, you must be at least 18 years of age as of Nov. 11, 2022 and a legal resident of Washington state. Pet Pros employees, vendors, contractors and their immediate family members are not eligible to participate.

HOW TO ENTER

Enter at any Pet Pros store during business hours Friday, Nov. 11, 2022 –Sunday, November 27, 2022.
Any photo showing animals displayed in an inappropriate manner (in the sole discretion of Sponsor) will be disqualified. By submitting an entry, you agree to abide by these rules.

RIGHTS /RELEASE

Any photograph that you publish to enter must be your original work, and you must have full ownership rights to the photo. By entering, you hereby grant Sponsor a royalty-free, irrevocable, perpetual, non-exclusive license to use, reproduce, modify, publish, create derivative works from, and display such photo, and to use the animal’s name and likeness, in whole or in part, on a worldwide basis, and to incorporate the photo into other works, in any form, media or technology now known or later developed, including for any promotional or marketing purpose.

By accepting a prize, each winner grants Sponsor the right to use the winner’s name, voice, signature, photo and likeness (as well as the name, photo and likeness of the animal in the entry) for advertising, publicity, promotional and other purposes in any and all media, now or hereafter devised, throughout the world in perpetuity, without additional compensation, notification or permission, except where prohibited by law.

SELECTION OF WINNERS

Three prizes will be awarded at each Pet Pros location. The winners will be selected randomly. In-store winners will be contacted by phone by November 28, 2022. In-store winners must submit a high quality pet photo via email on or before Monday, December 5, 2022 in order to receive a caricature drawing. Limits: Only one prize per person and only one winner per household.

OTHER TERMS REGARDING PRIZES

Any expenses, including all federal, state and local taxes associated with the prize (if any), will be the responsibility of the winner. Prizes are non-transferable. In the event any prize is not claimed within ten (10) days of notification (or is otherwise rejected by the winner), the prize will be forfeited.

GENERAL TERMS REGARDING ADMINISTRATION OF Contest

Sponsor is not responsible for any lost, late, incomplete, illegible, inaccurate, delayed, stolen, misdirected, undelivered or garbled entry; or for lost, interrupted or unavailable network, server, ISP, website, or other connection; or for any other technical failure or jumbled, scrambled, delayed, or misdirected transmission or computer hardware error or malfunction in connection with the Contest. Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Contest for any reason, including, but not limited to, any corruption or impairment of the administration, security, fairness or proper play of the Contest (in Sponsor’s sole discretion), and, if terminated, to forfeit prizes. All decisions of Sponsor in any matter relating to this contest shall be binding and final.

LIMITATION OF LIABILITY

By entering the Contest, each entrant agrees that Sponsor and its officers, directors, employees and agents (collectively, “Released Parties”) (a) shall not be responsible or liable for, and are hereby released from, any and all costs, injuries, losses or damages of any kind, including, without limitation, death and bodily injury, due in whole or in part, directly or indirectly, to participation in the Contest, or from entrant’s acceptance, receipt, possession and/or use or misuse of a prize (including any travel or activity related thereto); (b) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, incidental, consequential or any other indirect damages, other than for actual out-of-pocket expenses; © all causes of action arising out of or connected with this Contest, or any prize awarded, shall be resolved individually, without resort to any form of class action; and (d) any and all claims, judgments, and award shall be limited to actual out-of-pocket costs incurred, excluding attorneys’ fees and court costs.

GOVERNING LAW

All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of participants or Sponsor in connection with the Contest shall be governed by and construed in accordance with the laws of the State of Washington, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other state laws. By entering, each entrant consents to the jurisdiction and venue of the federal, state and local courts.
